Career Specialist & Agent Terms
Terms for independent career specialists, agents, and reworkers providing services on the platform.

1. Independent Contractor Status
1.1 Contractor Relationship
Career specialists, agents, and reworkers ("Agents") are independent contractors. By using the Platform as an Agent, you acknowledge and agree that you are NOT an employee, agent, representative, partner, or joint venturer of Remote-Works. Nothing in these Terms creates an employment or agency relationship.
1.2 Self-Direction
As an independent contractor, you have complete control over:
- Your work schedule, hours, and availability
- Your methods, techniques, and approaches to service delivery
- Your fees, rates, and pricing structures
- Which clients to accept or decline
- The tools and resources you use in your work
1.3 Tax & Legal Obligations
You are solely responsible for all tax obligations, insurance, licenses, and permits required in your jurisdiction. Remote-Works will not withhold taxes, provide benefits, or issue employment-related documentation. You may receive tax information forms (such as T4A or 1099) as required by law.
2. Agent Responsibilities
2.1 Service Quality
Agents agree to provide services in a professional, competent, and ethical manner. You must:
- Deliver services as described and agreed upon with clients
- Communicate honestly and transparently about your qualifications and capabilities
- Not make guarantees regarding employment outcomes, approvals, or income
- Maintain confidentiality of client information
- Comply with all applicable laws and the Platform Code of Conduct
- Respond to client communications in a timely manner
2.2 Prohibited Agent Conduct
Agents are strictly prohibited from:
- Guaranteeing employment, approval, or specific outcomes to clients
- Misrepresenting qualifications, success rates, or affiliations
- Engaging in fraudulent, deceptive, or illegal practices
- Soliciting clients to bypass the Platform for payments
- Sharing client personal information without authorization
- Operating multiple agent accounts
- Engaging in any activity that could harm the Platform or its users
3. Agent Fees & Earnings
3.1 Fee Setting
Agents set their own fees for services. Remote-Works may set minimum or maximum fee guidelines but does not dictate specific pricing. Fees must be clearly communicated to clients before services begin.
3.2 Platform Commission
Remote-Works may deduct a platform commission from Agent earnings for transactions facilitated through the Platform. Commission rates are disclosed on the Platform and may be updated with notice.
3.3 Payment Processing
Agent payouts are processed through third-party payment providers according to the payout schedule specified on the Platform. Remote-Works is not responsible for payment delays caused by third-party processors, banking issues, or incomplete payout information provided by the Agent.
4. Agent Performance & Reviews
Agents may be subject to client reviews, ratings, and performance evaluations. These ratings affect your visibility and ranking on the Platform. Remote-Works reserves the right to:
- Display reviews and ratings publicly on your agent profile
- Adjust agent rankings and visibility based on performance metrics
- Investigate and remove fraudulent or abusive reviews
- Suspend or terminate agent accounts based on sustained poor performance or policy violations
5. Agent Indemnification
Agents agree to indemnify, defend, and hold harmless Remote-Works from any claims, damages, losses, or expenses arising from:
- Services provided to clients through the Platform
- Misrepresentation of qualifications or false promises made to clients
- Violations of these Terms or the Code of Conduct
- Tax disputes, worker classification challenges, or regulatory actions
- Any claims by clients, third parties, or regulatory bodies
6. Termination of Agent Status
Remote-Works reserves the right to suspend, restrict, or terminate any Agent account at any time and for any reason, including but not limited to:
- Violation of these Terms or the Code of Conduct
- Client complaints or consistently poor performance reviews
- Suspected fraud or illegal activity
- Extended inactivity on the Platform
- At our sole discretion for any reason or no reason
Upon termination, pending earnings will be paid out according to the standard payout schedule, less any amounts owed to Remote-Works or subject to dispute holds.
