Employer & Company Terms
Terms for businesses posting jobs, hiring talent, and using enterprise recruitment features.

1. Employer Account
1.1 Account Registration
By registering as an employer or company on Remote-Works, you represent and warrant that you have the authority to bind the organization you represent. You are responsible for all activity under your company account, including activity by authorized team members.
1.2 Company Profile
All company information, including business name, description, industry, and job postings, must be accurate, truthful, and not misleading. Remote-Works reserves the right to verify company information and remove or restrict profiles that contain false or misleading information.
1.3 Account Ownership
As between employer users and the organization, the employer account belongs to the organization. However, if an individual user has a personal account separate from an employer account, the personal account remains the property of the individual.
2. Job Posting Responsibilities
2.1 Lawful Postings
Employers are solely responsible for ensuring that all job postings, recruitment communications, and hiring practices comply with applicable laws in every jurisdiction where the position is offered, including but not limited to:
- Anti-discrimination and equal opportunity employment laws
- Minimum wage and labor standards
- Work eligibility and immigration requirements
- Privacy and data protection regulations
- Occupational health and safety requirements
- Contractor classification and employment status laws
2.2 Prohibited Postings
Employers may not post jobs that:
- Discriminate based on race, gender, age, religion, disability, sexual orientation, or other protected characteristics
- Require applicants to pay fees or purchase products as a condition of employment
- Are misleading regarding compensation, job duties, or employment terms
- Request sensitive personal information (Social Security numbers, bank details, government IDs) through the platform
- Violate any applicable law or regulation
- Are fraudulent, deceptive, or relate to illegal activities
2.3 Hiring Decisions
All hiring and recruitment decisions are made solely by the employer. Remote-Works does not participate in, influence, or take responsibility for any hiring decision. Employers must use their own independent judgment and may not rely on or delegate decision-making authority to the Platform.
3. Talent Access & Usage
3.1 Candidate Information
Employers may access candidate profiles, verified credentials, and proof-of-work data solely for the purpose of evaluating candidates for legitimate employment or contract opportunities. Employers may NOT:
- Use candidate data for purposes other than legitimate recruitment
- Sell, share, or distribute candidate information to third parties without authorization
- Use data for discriminatory screening or profiling
- Contact candidates for unsolicited marketing or sales purposes
- Harvest, scrape, or bulk download candidate data
3.2 Confidentiality Obligations
Employers must maintain the confidentiality of all candidate information accessed through the Platform and handle such information in compliance with applicable privacy and data protection laws, including PIPEDA, GDPR, and CCPA as applicable.
4. Enterprise & SwiitchAssess Terms
Employers using SwiitchAssess or enterprise features acknowledge that hiring intelligence scores, role-fit assessments, regret minimizer reports, and bias detection tools are provided as informational aids only. These tools do not constitute employment advice, and employers retain full responsibility for all hiring decisions.
Assessment results and AI-generated insights may contain errors or inaccuracies. Employers must not rely solely on automated tools for hiring decisions and must ensure compliance with applicable AI and automated decision-making regulations in their jurisdiction.
5. Employer Indemnification
Employers agree to indemnify, defend, and hold harmless Remote-Works from any claims, damages, losses, or expenses arising from:
- Unlawful job postings or discriminatory hiring practices
- Misuse of candidate data or privacy violations
- Misclassification of workers (employee vs. contractor)
- Employment disputes with workers hired through the Platform
- Breach of applicable employment, labor, or data protection laws
- Any claims by candidates or third parties related to the employer's use of the Platform
6. No Employment Relationship
Use of the Platform does not create any employment, joint employment, agency, partnership, or franchise relationship between Remote-Works and any employer, candidate, or agent. Remote-Works is a technology platform provider only and bears no responsibility for any employment relationship that may arise between users of the Platform.
